Terms of Use

1. Acceptance

By using Diagnostix360, Data Insight, the website or related reports/content, you agree to these Terms and the privacy policy that applies to the product you use: Diagnostix360 Privacy or Data Insight Privacy. If you do not agree, do not use them. These Terms apply only to the extent permitted by applicable law.

2. What the apps are — and are not

Diagnostix360 is a troubleshooting and measurement aid for Wi-Fi, mobile and Internet connections. It can show point-in-time radio, local-path, Internet, DNS, route, service and readiness evidence and can generate Customer or Technical reports.

Data Insight is an on-device usage-analysis aid. It reads usage and screen-time records exposed by Android and turns them into app-attributed totals, overnight summaries, data-plan forecasts and estimated savings after removing an app. These figures depend on what the device records and are not carrier billing records or certified measurements.

• Results describe the device, network, targets and conditions observed during the test window and can change immediately afterward.
• Ping/ICMP can be filtered or deprioritized. A missed reply does not automatically prove packet loss, an outage or ISP fault.
• Weak signal, high latency, DNS behavior, service reachability and readiness scores are evidence, not proof of legal, contractual or engineering responsibility.
• Readiness scores are estimates. Diagnostix360 does not run every real game, call, video session or website experience.
• Unless expressly stated, the app does not certify sustained throughput, contractual SLA compliance, security posture, regulatory compliance or every possible network condition.

Neither app is your ISP, mobile operator, regulator, cybersecurity auditor, lawyer, emergency service, billing authority or professional engineering adviser. Do not rely on either app as the sole basis for a legal, contractual, safety, security, financial, service-disconnection, purchase or business decision.

3. Your responsibilities

You are responsible for how you use either app and for interpreting or acting on its output. Use diagnostics only on devices and networks you own, legitimately use or are authorized to test. Review Data Insight suggestions before changing Android settings, restricting background data or uninstalling an app, because those actions can affect messaging, backup, maps or other app behavior. Do not use either app to interfere with, overload, attack, bypass security on or gain unauthorized access to any system or network.

You are also responsible for reviewing reports before sharing them, choosing the recipient, and protecting any network or personal information contained in a Technical report.

4. Scores, estimates, reports, statistics and articles

Scores, History, readiness results, ISP statistics, Data Insight forecasts/savings estimates and articles are informational outputs based on available records, samples, rules and assumptions. They are not warranties, certifications, carrier billing records, SLA evidence, regulatory findings, legal conclusions or statements that a provider, app developer or third party is at fault. Provider/carrier records, platform behavior, contractual terms and independent professional investigation may produce a different conclusion.

5. Third-party services and links

Diagnostix360 diagnostics may contact third-party networks, DNS resolvers, public-IP/profile services, reference targets and common Internet services. Data Insight itself is distributed without Android's INTERNET permission, but it can open Android system screens, the uninstall confirmation or your email app when you choose those actions. The website may link to third-party sites. Their availability, behavior, content, security, privacy practices, charges and policies are outside our control. A reference or link does not mean endorsement, affiliation or responsibility for that third party.

6. “As is” software — no warranty

To the maximum extent permitted by law, Diagnostix360 and Data Insight are provided “as is” and “as available”, with all faults and without any express, implied or statutory warranty. We do not guarantee accuracy, completeness, availability, fitness for a particular purpose, merchantability, non-infringement, compatibility, uninterrupted operation, error-free operation, preservation of data, or that a result will identify the real cause of a connection problem.

You assume the risk of using the software, website, articles and reports and of any decision or action you take based on them.

7. Limitation of liability

To the maximum extent permitted by applicable law, Diagnostix360 and its operator will not be liable for any loss, damage, cost, claim or dispute arising from or related to the app, website, articles, reports, third-party requests, or your use of or reliance on them. This includes, without limitation, direct or indirect loss, incidental, special, consequential, exemplary or punitive damages; loss of profits, revenue, opportunity, goodwill or data; device, network or service interruption; extra data, roaming or service charges; loss caused by inaccurate or incomplete results; and disputes with an ISP, operator, employer, customer or other third party.

If applicable law does not allow a particular exclusion, that exclusion applies only to the maximum extent legally allowed. Where a monetary cap is legally permitted, our total aggregate liability for all claims relating to Diagnostix360 or Data Insight will not exceed the greater of the amount you actually paid us for the relevant app during the 12 months before the claim or US$10. Nothing in these Terms excludes liability that cannot lawfully be excluded.

8. Indemnity for misuse

To the extent permitted by law, you are responsible for claims, losses or costs caused by your unlawful, unauthorized or abusive use of Diagnostix360 or Data Insight, your breach of these Terms, or your misuse or disclosure of reports and data. Where legally enforceable, you agree to indemnify and hold the Diagnostix360 operator harmless from such claims.

9. Privacy

Data handling is described in the applicable policy: Diagnostix360 Privacy and Data Insight Privacy. Diagnostix360 Diagnostic Data Sharing and Usage Analytics are separate optional choices. Data Insight has no Internet permission; when it opens Android's share sheet or your email app, you choose whether and where to send anything. You are responsible for information you deliberately share through a report, screenshot, email or other sharing method.

10. Intellectual property

Diagnostix360 and Data Insight software, branding, original methodology, documentation, website design and original written content are protected by applicable intellectual-property laws. Third-party names and trademarks belong to their respective owners.

11. Availability, updates and data preservation

Features, targets, thresholds, scoring rules, providers, URLs, caches and external dependencies may change, be suspended or be discontinued without guarantee of notice. We do not promise that every Android device or network will expose every measurement or usage record, that every estimate will match carrier billing, that the service will always be available, or that local History/reports/settings will survive device changes, app removal, storage clearing, updates, backup/restore behavior or other platform behavior.

Unless required by law, we have no obligation to provide support, preserve a particular result, maintain a specific feature or continue a specific third-party integration.

12. Mandatory rights, severability and no waiver

Nothing in these Terms removes consumer, privacy or other rights that cannot legally be waived. If part of these Terms is found invalid or unenforceable, the remaining parts remain in effect to the extent allowed by law. A failure to enforce a provision is not a waiver of that provision.

13. Changes and contact
