Terms of Use
These terms set the rules for using Diagnostix360 and explain the limits of diagnostic results and reports.
1. Agreement and service operator
These Terms of Use (“Terms”) govern the Diagnostix360 Android application, diagnostix360.com and related documentation (together, the “Service”). “Diagnostix360”, “we”, “us” and “our” refer to the operator of the Service under the Diagnostix360 name. By installing, accessing or using the Service, you accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. What the Service does
The Service performs network and connection diagnostics and presents measurements, scores, findings, suggested troubleshooting actions, history, monitoring information and reports. Results may depend on the Android device, permissions, active connection, network configuration, remote targets, congestion, routing, radio conditions, operating-system restrictions and other conditions outside our control.
3. Diagnostic results are not guarantees
All scores, statuses, readiness estimates, measurements, findings and suggested actions are informational and point-in-time only. A successful check does not prove that a connection is always healthy, secure or suitable for a particular purpose. A warning or failed probe does not by itself prove the cause of a service problem. Results should be interpreted with other evidence when the decision is important.
4. Not professional, certified or provider-authoritative advice
The Service is not a substitute for professional engineering, security, legal, regulatory, medical, emergency, contractual, service-level or provider-certified testing. Reports are not official proof of an outage, breach, contractual non-performance or entitlement to compensation unless a relevant third party independently chooses to accept them.
5. Your responsibility and authorised use
You are responsible for using the Service lawfully and only on devices, networks and systems you own or are authorised to test. Do not use the Service to probe, scan, interfere with, disrupt or obtain information from systems where you lack permission. You are responsible for confirming that your use complies with applicable law, contracts, workplace rules, provider terms and network-owner requirements.
6. Reports, exports and sharing
A completed full diagnosis can create both a simplified Customer report and a detailed Technical report. The Customer report is designed to omit sensitive technical identifiers. The Technical report is the full evidence package and can contain network identifiers, addresses, location context, route information, device/mobile details and exact timestamps when available. Preview any report before sharing it; the app requires acknowledgement before selected sensitive reports are shared. Once you export or share a report, the recipient, messaging service, email provider, cloud service or other third party may retain or copy it, and that handling is outside our control.
7. Software, updates and changes
Software can contain defects, incomplete behavior, inaccurate measurements or compatibility issues. We may change scoring, thresholds, targets, methodology, wording, report schemas, supported features or compatibility as the Service evolves. Keep the app updated when practical and identify the app/report version when comparing results produced by different releases.
8. Network traffic and third-party services
Diagnostics can send requests to network destinations in order to measure connectivity or service setup. Those destinations, Android, Google Play, your ISP/mobile operator and any service used to share a report are independent third parties governed by their own terms and policies. Diagnostix360 does not control their availability, routing, data practices or behavior.
9. Privacy
Our handling of app data and user-initiated exports is described in the Privacy Policy and the Data Protection summary. You are responsible for protecting reports and exports after you choose to save or share them.
10. Availability and compatibility
We do not promise that the Service will be uninterrupted, error-free, compatible with every Android device or network, or available in every location. Android background limits, permissions, device sleep, vendor modifications and network restrictions can affect diagnostics or monitoring. Features may be changed, suspended or discontinued where reasonably necessary.
11. Purchases
If paid features or subscriptions are offered through Google Play, the price, billing period, renewal and cancellation terms shown by Google Play at the time of purchase apply in addition to these Terms. Payment processing is handled by the store/payment provider under its own terms. Any mandatory refund or consumer rights remain governed by applicable law and the store’s rules.
12. Intellectual property and licence
Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for lawful diagnostic purposes. The Service, branding, original interface, documentation and original report designs are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
13. Prohibited conduct
You must not misuse the Service, attempt to defeat security controls, distribute malicious or altered versions as genuine Diagnostix360 software, use the Service to violate another person’s rights, or use reports in a misleading manner that materially misrepresents what was measured.
14. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties or conditions of any kind, whether express, implied or statutory. To the extent permitted by law, we disclaim implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement and any warranty arising from course of dealing or usage. We do not warrant that a result, score, recommendation, report or monitoring session will be complete, error-free or suitable for your intended purpose.
15. Limitation of liability
To the maximum extent permitted by applicable law, Diagnostix360 and the Service operator will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses, or for loss of profits, revenue, business, opportunity, goodwill, data, service availability or anticipated savings, arising from or related to the Service or reliance on its results.
Where liability cannot be fully excluded, and to the maximum extent permitted by law, aggregate liability arising out of or relating to the Service will not exceed the amount you paid specifically for the Service during the 12 months immediately before the event giving rise to the claim. If you paid nothing for the Service, the aggregate cap is zero to the extent such a cap is legally permitted.
16. Rights that cannot be excluded
Nothing in these Terms excludes, restricts or modifies any mandatory consumer right or liability that applicable law does not allow to be excluded or limited. Nothing is intended to exclude liability for fraud, fraudulent misrepresentation, wilful misconduct or any other matter that cannot lawfully be excluded.
17. Changes, suspension and discontinuation
We may update, change, suspend or discontinue the Service, a feature, diagnostic target or website where reasonably necessary for product, security, legal or operational reasons. We may update these Terms by publishing a revised version and date. Your continued use after an updated version becomes effective constitutes acceptance to the extent permitted by applicable law.
18. Severability and entire agreement
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. These Terms, together with the Privacy Policy and any mandatory store terms that apply to your acquisition of the app, form the agreement relating to your use of the Service.
